Policies (And Other Legal Things You Should Know!)

Hey there! If you're seeing this page it's because you've decided you might want to book a session with me! I'd absolutely love working with you, but before we get started we need to lay down some ground rules so both you and I make sure we're on the same page moving forward. In fairness to all my other clients, I must keep to my policies as closely as possible to protect both of us.

Once you've finished reading these, please confirm with me that you understand the policies I've laid out. If you have any questions, let me know!

Payments & Payment Plans:

I require a non-refundable retainer of 1/2 of your total fee for senior sessions, portrait sessions, couples/engagement sessions, and family sessions to book your date and time and 1/4 of your total fee for wedding bookings. This is to protect my time in case of sudden cancellation.

I accept cash, personal check, Venmo, Cash App, and invoicing through Square or PayPal. A $30 administrative fee will be added to orders where a check doesn't clear. If you have had a returned check I have the right to require cash only for payment or not release any product until we can confirm the check has cleared.

I am very happy to offer a payment plan to those who want it. Client must sign an agreement and put a credit card on file. Your balance will be split up into 2-8 payments, depending on the type of session. The first of payments will be made when signing the payment plan. Then the remaining payments will be made every other week on the same day of the week. Absolutely no product will be delivered until the entire order is paid in full. At the end of the payment plan, the products must be paid in full. If for some reason they are not, I will remind you once to finish paying. If it still is not paid within 3 days of the warning, I will be forced to take legal action.

Important Session Things:

I will check in with you 48 hours before our session to remind you/confirm with you that we have a session coming up. If I do not receive confirmation within 24 hours of my message, your session slot will be lost and you will be required to reschedule with no refund of your retainer.

Since I want to give each client my full attention as well as their full amount of time, I ask that you please be on time to our session. Although I love my clients to be early, I recommend that you do not arrive more than 15 minutes prior to your appointment unless previously discussed with me. If you are over 15 minutes late for your scheduled time, I reserve the right to cancel your session and keep your retainer. Keep in mind that weekend and evening sessions are in high demand and although I will go to great lengths to meet your scheduling needs, these sessions may book well in advance.

You're welcome to bring a friend or family member along to your session if you want to help you feel more confident and relaxed. In the case you do bring someone with you, the extra person is not allowed to take photos of their own in any capacity during our session time and must not interfere in our session time in any way that may slow us down.

I will have your digital photo gallery delivered to you in a minimum of 4 weeks for senior sessions, portrait sessions, couples/engagement sessions, and family sessions and 8 weeks for wedding bookings.

Cancellations:

If you need to reschedule your session due to sickness, injury or a scheduling conflict, please contact me as soon as possible and I can happily reschedule and the retainer will move with the session. In the event of a no show/no call your will not only lose your retainer, but to rebook you will be required to pay the session fee upfront, and it will be non-refundable.

Respectfully, I also reserve the right to reschedule a session due to illness, emergency, death in the family, inclement weather, and other unforeseen events beyond my control. I will be sure to inform you of any such occurrences as soon as possible and will reschedule your session in the earliest date available.

The Copyright Act protects photographers by giving us, the artists, exclusive rights to reproduce your photographs. Violations include, but are not limited to, making illegal copies, scanning, or printing from home without consent. It is illegal to copy or reproduce these photographs in any manner without our permission and violators of this Federal Law will be subject to its civil and criminal penalties. Please understand , the photographer wishes to maintain complete control over the print quality, finishes and presentation of the images and any reproduction outside of the studio may lower the quality of the image and scar our reputation for providing superior portraits.

Molli Harvey Photography owns the copyright to all images. It is illegal to copy, scan, print or reproduce photographs or digital images created by Molli Harvey Photography without a paid print release. By doing so, you are devaluing my work as an artist. Fines will start at $50,000 for copyright infringement.

Pets:

I love pets! If you'd like to include your furry, scaly, or feathered friend along with you to your session, please let me know and we can absolutely make it work! Pets must be leashed/harnessed/in a carrier at all time.

Reshoots:

My goal as a professional photographer is to make you excited and happy with your photos. There is no charge for re-shoots due to technical issues (equipment malfunction, computer malfunction, etc.). However, due to the creative nature of what I do, I cannot offer free re-shoots for any reason including dissatisfaction with clothing, facial expressions, hair, wind, makeup or other items beyond our control. In the event that you would like to schedule another session due to one of the above, I will offer a NEW session at half price and must be scheduled within 2 weeks of your regular session. All the photos from the original session will be deleted.

Archiving Images:

While I try my hardest to back up your images and keep them in a safe place, the problem with keeping digital products is anything can happen. Cloud back up service may not work and hard drives can go bad. I do my best to keep your images safe for the minimum amount of time (60 days), but I do not guarantee it, and assume no liability for lost digital files after delivery.
